Agreement and eligibility

By creating an account or using USFoodTrader, you agree to these Terms and the policies linked from them. You must be legally able to enter into this agreement and authorized to act for any business you represent. Account information must be accurate and kept current.

Accounts and access

• Buyer access supports browsing, RFQs, inquiries, saved products, and related buyer workflows.
• Seller access supports company profiles, product listings, storefront content, and responses to marketplace inquiries.
• Buy & Sell access combines supported buyer and seller features in one account.
• You are responsible for account credentials, authorized company members, and activity performed through your account. Notify USFoodTrader promptly of suspected unauthorized access.

Marketplace use

Listings, indicative prices, availability, certifications, origins, specifications, quotations, and other marketplace information must be accurate and not misleading. Buyers and sellers must perform appropriate due diligence and comply with applicable laws and trade requirements.

The current website does not provide online checkout and does not process marketplace payments, subscriptions, or commissions. Quotes, inquiries, order-workflow records, and requested payment terms are coordination tools; they do not by themselves complete payment, transfer title, guarantee supply, or create a USFoodTrader-backed transaction.

User content

You retain ownership of content you submit. You grant USFoodTrader a non-exclusive, worldwide, royalty-free license to host, reproduce, format, display, translate, moderate, and distribute that content as reasonably needed to operate and promote the marketplace and your approved listings. You confirm that you have the necessary rights and permissions.

Prohibited conduct

You may not use the service for fraud, unlawful trade, deceptive listings, harassment, spam, malicious uploads, unauthorized scraping, security testing without written authorization, circumvention of access controls, infringement, or misuse of another person's information. The Acceptable Use Policy provides additional rules.

Review, suspension, and termination

USFoodTrader may review accounts and content, request supporting information, reject or remove content, limit features, suspend access, or terminate an account when reasonably necessary for safety, policy enforcement, legal compliance, service integrity, or business operations. Users may delete their account through available Settings controls, subject to the Account and Data Deletion notice.

Additional and third-party services

Tomasino Farms or other providers may separately offer sourcing, importing or exporting assistance, logistics coordination, trade-finance introductions, regulatory support, or other services. Any such service requires separate confirmation and may be subject to additional terms. Third-party websites, integrations, and providers are governed by their own terms.

Disclaimers and liability

The platform and marketplace information are provided on an 'as available' basis. To the maximum extent permitted by applicable law, USFoodTrader disclaims implied warranties and does not guarantee user identity, product quality, availability, regulatory compliance, transaction completion, uninterrupted service, or the accuracy of user-provided content.

To the maximum extent permitted by applicable law, USFoodTrader and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, business interruption, or disputes between marketplace participants arising from use of the platform. Rights that cannot lawfully be excluded remain unaffected.

Changes and contact

We may change the service or these Terms. Material changes will be presented through an appropriate notice or updated agreement where required. Continued use after an effective update constitutes acceptance to the extent permitted by law. Contact USFoodTrader through the Contact page with questions.
